Affiliate Terms & Conditions

These Affiliate Terms & Conditions (the “Agreement”) govern your participation in the Voyabay Affiliate Program (the “Program”). By creating an affiliate account or participating in the Program, you agree to this Agreement.
1. Eligibility and enrollment
You must be at least 18 years old and able to enter a binding contract. You must provide accurate, current information and keep your account secure. Voyabay may accept or reject an application and may require identity, tax, payment, or compliance information.
2. Affiliate relationship
You are an independent contractor, not an employee, agent, partner, franchisee, or legal representative of Voyabay. You may not make commitments on Voyabay’s behalf. You are responsible for your expenses, taxes, permits, and compliance obligations.
3. Referral tracking and commissions
Eligible commissions are based on qualifying bookings attributed to your approved referral link or code under the commission rate shown in your dashboard or otherwise agreed in writing. A referral tracking cookie may remain active for up to 30 days after a visitor clicks your approved referral link. Tracking and attribution are not guaranteed if the visitor clears or blocks cookies, uses another device or browser, follows another referral, changes the link, or if other technical factors interfere. Voyabay’s records control unless you show a clear error.
Only hotel and vacation rental bookings completed on voyabay.com qualify for commissions. Flights, activities, experiences, car rentals, insurance, and any other non-lodging products booked through Voyabay do not earn commission. Clicks or bookings that leave voyabay.com — including outbound links to third-party comparison rates, partner sites such as Booking.com, Expedia, or other suppliers, and any bookings completed off Voyabay — do not earn commission regardless of whether the visitor originally arrived through your referral link.
A commission becomes eligible seven days after the guest’s completed checkout, provided the booking was fully completed and paid and is not subject to cancellation, refund, chargeback, fraud review, or adjustment. Partially refunded bookings do not earn any commission; only fully completed, non-refunded bookings qualify. Voyabay may reverse or offset commissions relating to canceled, partially or fully refunded, duplicate, fraudulent, self-referred, improperly attributed, or otherwise ineligible transactions.
4. Payments and tax information
Eligible payouts are processed on a weekly basis, subject to the minimum balance, verification requirements, review, banking holidays, and processing times displayed in the Program. An affiliate may not receive more than one payout in any seven-day period.
PayPal is the Program’s only available payout method. You must provide and maintain an accurate PayPal email address and a PayPal account capable of receiving payment. Voyabay does not offer checks, bank transfers, store credit, cryptocurrency, or another payment method. Once Voyabay correctly sends a payment to the PayPal account you provided, account access problems, PayPal holds, limitations, conversion, transfer delays, rejected transfers, and other issues within PayPal’s services must be resolved between you and PayPal. Voyabay remains responsible for correcting a payment that its records confirm was not sent as instructed. You are responsible for PayPal fees and for all taxes on your earnings.
Voyabay may request a completed Form W-9 or other applicable tax documentation at any time. If your cumulative Program payments or payable earnings reach $2,000 in a calendar year, Voyabay may withhold further payment until it receives and validates the required tax documentation. Amounts withheld for missing documentation remain subject to this Agreement and are not forfeited solely because payment is delayed. Voyabay may make legally required reporting or backup withholding.
5. Advertising disclosures and truthful promotion
Whenever you promote Voyabay or use an affiliate link, you must clearly and conspicuously disclose your financial relationship with Voyabay in the endorsement itself and near the link or recommendation. A disclosure such as “I may earn a commission if you book through this link” is generally appropriate when it is easy to notice and understand. You must follow the FTC Endorsement Guides and all other advertising, consumer-protection, privacy, email, telemarketing, and platform rules that apply to you.
Your statements must be honest and based on your actual experience. You may not make false, misleading, unsubstantiated, or deceptive claims; hide required disclosures; publish fake reviews; or imply that Voyabay directly endorses you.
6. Prohibited activity
You may not:
- generate referrals through fraud, bots, misleading redirects, cookie stuffing, forced clicks, or other artificial means;
- place bookings through your own referral link unless Voyabay expressly permits it in writing;
- send unlawful or unsolicited messages or violate anti-spam rules;
- bid on, register, or use Voyabay names or confusingly similar terms in domains, accounts, paid-search keywords, or advertising without written approval;
- copy Voyabay content or collect personal data except as expressly authorized; or
- promote Voyabay alongside unlawful, deceptive, hateful, infringing, or sexually explicit content.
7. Brand assets and custom websites
Voyabay grants you a limited, revocable, nonexclusive, nontransferable license to use approved Voyabay links, widgets, and brand assets only to participate in the Program. Voyabay and its licensors retain all rights in the Voyabay name, platform, technology, content, and brand assets.
If Voyabay creates or provides a custom website for you, the website itself—including its code, design, templates, functionality, and Voyabay-provided content—belongs to Voyabay unless a separate written agreement says otherwise. You continue to own domain names you purchased and your preexisting names, logos, trademarks, and branding. You grant Voyabay permission to use those materials as needed to build, host, operate, and support the custom website. Program termination may end your right to use or operate the Voyabay-owned website.
8. Monitoring and records
Voyabay may monitor referrals and promotional activity for quality, fraud, legal compliance, and compliance with this Agreement. You agree to provide reasonable information about your promotional methods when requested and to promptly correct or remove noncompliant material.
9. Suspension and termination
You may stop participating at any time. Voyabay may suspend or close your account, remove referrals, or restrict Program access if Voyabay believes, in its sole discretion, that you violated this Agreement, another Voyabay policy, applicable law, or created risk to Voyabay, its travelers, suppliers, or reputation.
If your account is closed, Voyabay will pay the remaining valid amount due after applying cancellations, refunds, chargebacks, offsets, minimum payout rules, and legally required tax or identity documentation. No commission is owed for fraudulent, invalid, or policy-violating activity. Sections intended by their nature to survive termination—including payment adjustments, ownership, disclaimers, liability, and indemnification—will survive.
10. Program changes
Voyabay may change commission rates, attribution rules, features, payout procedures, or this Agreement. Material changes will be posted in the Program or otherwise communicated when required. Changes apply prospectively from their stated effective date. Continuing to participate after a change takes effect means you accept it.
11. Confidentiality and privacy
Nonpublic business, technical, customer, pricing, and Program information shared with you is confidential. You may use it only for the Program and must protect it from unauthorized access. You may not access, use, sell, or disclose traveler personal information except as expressly authorized and legally permitted.
12. Disclaimers and limitation of liability
The Program, links, tools, and reporting are provided “as is” and “as available.” To the fullest extent permitted by law, Voyabay disclaims implied warranties, including merchantability, fitness for a particular purpose, and noninfringement, and does not guarantee uninterrupted operation, any level of traffic, bookings, or earnings.
To the fullest extent permitted by law, Voyabay will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages or lost profits or data. Voyabay’s total liability arising from the Program will not exceed the commissions paid or payable to you during the six months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so they apply only to the extent permitted.
13. Indemnification
You will defend, indemnify, and hold harmless Voyabay and its owners, affiliates, officers, employees, and service providers from claims, losses, liabilities, costs, and reasonable legal fees arising from your promotions, content, sites, legal violations, breach of this Agreement, or misuse of the Program or Voyabay materials.
14. General terms
You may not transfer this Agreement or your account without Voyabay’s written consent. If any provision is unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver. This Agreement and any written Program-specific terms are the entire agreement concerning the Program. Electronic acceptance and records have the same effect as signed paper records.
